Terms and Conditions | Charming Safaris

By engaging with Charming Safaris (the “Company,” “we,” “us,” or “our”) for any travel-related services, the Client (the “Traveler,” “you,” or “your”) agrees to be legally bound by the following terms.
1. Booking, Deposits, and Final Payments

The Deposit: To secure your space in a safari vehicle and confirm lodge availability, a non-refundable deposit of 30% is required at the time of booking. For international packages involving flight tickets, the deposit may be higher to cover 100% of the airfare cost.

Balance Due: The remaining 70% must be paid no later than 45 days before your arrival. If the balance is not received by this date, Charming Safaris reserves the right to treat the booking as cancelled by the Client.

Last-Minute Bookings: Any booking made within 45 days of departure requires 100% immediate payment.
2. Comprehensive Cancellation Policy
Cancellations must be made in writing to enquiry@charmingsafariz.com. The following scale applies (calculated as a percentage of the total trip cost):

91+ Days Before Arrival: Loss of deposit only.

61 – 90 Days Before Arrival: 50% cancellation fee.

31 – 60 Days Before Arrival: 75% cancellation fee.

0 – 30 Days Before Arrival: 100% cancellation fee (No refund).

Partial Cancellations: If one member of a group cancels, the remaining members may be subject to a “Single Supplement” fee or a price increase due to reduced group size.
3. Safari-Specific Disclaimers (Wildlife & Environment)

Wildlife Sightings: While our guides are experts, wildlife is unpredictable. Charming Safaris does not guarantee sightings of specific animals (e.g., the Big Five or a Mara River crossing).

Route Changes: We reserve the right to change routes or accommodations if weather, road conditions, or animal movements make the original plan unsafe or inaccessible.

Safety Instructions: Clients must follow all instructions given by the driver-guide (e.g., staying inside the vehicle). Failure to do so voids all liability on our part.
4. International Tours & Visa Services

Visa Rejections: Charming Safaris acts only as an advisor. We are not liable for visa rejections by any embassy. If your visa is denied, our standard cancellation policy applies to the rest of your travel package.

Flight Delays: We are not responsible for airline delays or cancellations. Any extra hotel nights or transport costs resulting from flight changes are the responsibility of the Client or their travel insurance.
5. Medical, Insurance, and Evacuation

Mandatory Insurance: It is a condition of booking that every traveler has comprehensive travel and medical insurance.

Emergency Evacuation: For safaris in remote areas (Masai Mara, Samburu, etc.), we strongly recommend a subscription to AMREF Flying Doctors. We can arrange this for a small fee.

Physical Fitness: The Client warrants that they are in good health and able to undertake the rigors of a safari. Please inform us of any mobility issues or chronic conditions during the booking process.
6. Liability and “Force Majeure”
Charming Safaris shall not be liable for any loss, damage, or injury resulting from Force Majeure events, including but not limited to:

Acts of God (floods, earthquakes, etc.)

War, civil unrest, or terrorism.

Pandemics, strikes, or government-mandated lockdowns.

In such cases, we will issue a Travel Credit Note for future use rather than a cash refund, subject to the policies of our third-party suppliers (hotels/airlines).
7. Client Conduct & Responsibility

Respect for Nature: We promote sustainable tourism. Any client found harassing wildlife, littering, or disrespecting local cultures may be removed from the tour without a refund.

Baggage: While we take every care, the Company is not responsible for the loss of or damage to personal belongings. Please use soft-sided bags for safaris (weight limit usually 15kg for small bush planes).
8. Use of Photographic Material
Charming Safaris reserves the right to use any photographs or videos taken during tours for marketing and promotional purposes. If you prefer not to have your image used, please inform your guide at the start of the trip.
9. Dispute Resolution
Any dispute arising from these terms shall first be attempted to be resolved through amicable negotiation. If that fails, the matter will be referred to arbitration in Nakuru, Kenya, under the Kenyan Arbitration Act.
