Terms and Conditions | Charming Safaris

By engag­ing with Charm­ing Safaris (the “Com­pa­ny,” “we,” “us,” or “our”) for any trav­el-relat­ed ser­vices, the Client (the “Trav­el­er,” “you,” or “your”) agrees to be legal­ly bound by the fol­low­ing terms.


1. Booking, Deposits, and Final Payments

  • The Deposit: To secure your space in a safari vehi­cle and con­firm lodge avail­abil­i­ty, a non-refund­able deposit of 30% is required at the time of book­ing. For inter­na­tion­al pack­ages involv­ing flight tick­ets, the deposit may be high­er to cov­er 100% of the air­fare cost.

  • Bal­ance Due: The remain­ing 70% must be paid no lat­er than 45 days before your arrival. If the bal­ance is not received by this date, Charm­ing Safaris reserves the right to treat the book­ing as can­celled by the Client.

  • Last-Minute Book­ings: Any book­ing made with­in 45 days of depar­ture requires 100% imme­di­ate pay­ment.

2. Comprehensive Cancellation Policy

Can­cel­la­tions must be made in writ­ing to enquiry@charmingsafariz.com. The fol­low­ing scale applies (cal­cu­lat­ed as a per­cent­age of the total trip cost):

  • 91+ Days Before Arrival: Loss of deposit only.

  • 61 – 90 Days Before Arrival: 50% can­cel­la­tion fee.

  • 31 – 60 Days Before Arrival: 75% can­cel­la­tion fee.

  • 0 – 30 Days Before Arrival: 100% can­cel­la­tion fee (No refund).

  • Par­tial Can­cel­la­tions: If one mem­ber of a group can­cels, the remain­ing mem­bers may be sub­ject to a “Sin­gle Sup­ple­ment” fee or a price increase due to reduced group size.

3. Safari-Specific Disclaimers (Wildlife & Environment)

  • Wildlife Sight­ings: While our guides are experts, wildlife is unpre­dictable. Charm­ing Safaris does not guar­an­tee sight­ings of spe­cif­ic ani­mals (e.g., the Big Five or a Mara Riv­er cross­ing).

  • Route Changes: We reserve the right to change routes or accom­mo­da­tions if weath­er, road con­di­tions, or ani­mal move­ments make the orig­i­nal plan unsafe or inac­ces­si­ble.

  • Safe­ty Instruc­tions: Clients must fol­low all instruc­tions giv­en by the dri­ver-guide (e.g., stay­ing inside the vehi­cle). Fail­ure to do so voids all lia­bil­i­ty on our part.

4. International Tours & Visa Services

  • Visa Rejec­tions: Charm­ing Safaris acts only as an advi­sor. We are not liable for visa rejec­tions by any embassy. If your visa is denied, our stan­dard can­cel­la­tion pol­i­cy applies to the rest of your trav­el pack­age.

  • Flight Delays: We are not respon­si­ble for air­line delays or can­cel­la­tions. Any extra hotel nights or trans­port costs result­ing from flight changes are the respon­si­bil­i­ty of the Client or their trav­el insur­ance.

5. Medical, Insurance, and Evacuation

  • Manda­to­ry Insur­ance: It is a con­di­tion of book­ing that every trav­el­er has com­pre­hen­sive trav­el and med­ical insur­ance.

  • Emer­gency Evac­u­a­tion: For safaris in remote areas (Masai Mara, Sam­bu­ru, etc.), we strong­ly rec­om­mend a sub­scrip­tion to AMREF Fly­ing Doc­tors. We can arrange this for a small fee.

  • Phys­i­cal Fit­ness: The Client war­rants that they are in good health and able to under­take the rig­ors of a safari. Please inform us of any mobil­i­ty issues or chron­ic con­di­tions dur­ing the book­ing process.

6. Liability and “Force Majeure”

Charm­ing Safaris shall not be liable for any loss, dam­age, or injury result­ing from Force Majeure events, includ­ing but not lim­it­ed to:

  • Acts of God (floods, earth­quakes, etc.)

  • War, civ­il unrest, or ter­ror­ism.

  • Pan­demics, strikes, or gov­ern­ment-man­dat­ed lock­downs.

  • In such cas­es, we will issue a Trav­el Cred­it Note for future use rather than a cash refund, sub­ject to the poli­cies of our third-par­ty sup­pli­ers (hotels/airlines).

7. Client Conduct & Responsibility

  • Respect for Nature: We pro­mote sus­tain­able tourism. Any client found harass­ing wildlife, lit­ter­ing, or dis­re­spect­ing local cul­tures may be removed from the tour with­out a refund.

  • Bag­gage: While we take every care, the Com­pa­ny is not respon­si­ble for the loss of or dam­age to per­son­al belong­ings. Please use soft-sided bags for safaris (weight lim­it usu­al­ly 15kg for small bush planes).

8. Use of Photographic Material

Charm­ing Safaris reserves the right to use any pho­tographs or videos tak­en dur­ing tours for mar­ket­ing and pro­mo­tion­al pur­pos­es. If you pre­fer not to have your image used, please inform your guide at the start of the trip.

9. Dispute Resolution

Any dis­pute aris­ing from these terms shall first be attempt­ed to be resolved through ami­ca­ble nego­ti­a­tion. If that fails, the mat­ter will be referred to arbi­tra­tion in Naku­ru, Kenya, under the Kenyan Arbi­tra­tion Act.
